Terms of Use

These Terms of Use ("Terms") govern your use of the FitNemo application ("App"). By using the App, you agree to these Terms.

1. Description of Service

FitNemo is a fitness and nutrition tracking application that provides:

• Food journaling with AI-powered food recognition
• Workout tracking and AI-generated training programs
• Body composition tracking
• Apple Health / Health Connect integration
• Sleep and activity tracking
• Personalized calorie and macronutrient recommendations

2. Account

• You must be at least 17 years old to use the App
• You are responsible for maintaining the security of your account
• You are responsible for all activity under your account
• One person per account; accounts are non-transferable

3. Subscriptions

3.1 Free and Pro Plans

The App offers a free tier with limited AI features and a Pro subscription with unlimited access.

3.2 Billing

• Subscriptions are billed through the Apple App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Prices are displayed in the App before purchase and may vary by region

3.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

3.4 Refunds

Refund requests are handled by Apple according to their refund policy. We do not process refunds directly.

3.5 Free Trial

If offered, the free trial period is specified at the time of subscription. If you do not cancel before the trial ends, you will be charged for the subscription.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Upload malicious content, harmful files, or inappropriate photos
• Reverse-engineer, decompile, or disassemble the App
• Use automated systems to access the App (bots, scrapers)
• Impersonate another person or entity

5. AI Features Disclaimer

• AI-powered features (food recognition, body fat estimation, workout generation, sleep analysis) provide estimates only
• AI results should not be considered medical advice
• Calorie and macronutrient estimates may be inaccurate
• Always consult a healthcare professional before starting any diet or exercise program
• We are not responsible for decisions made based on AI recommendations

6. Health Disclaimer

FitNemo is not a medical application. The App is designed for general fitness and nutrition tracking purposes only.

• The App does not provide medical advice, diagnosis, or treatment
• Consult your doctor before making significant changes to your diet or exercise routine
• If you have a medical condition, consult a healthcare provider before using the App
• Stop using the App and seek medical attention if you experience adverse health effects

7. Intellectual Property

• The App, its design, code, and content are owned by FitNemo
• You retain ownership of your personal data and content (photos, notes)
• You grant us a limited license to process your data as described in the Privacy Policy

8. Termination

• You may delete your account at any time from the App settings
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your data will be deleted as described in the Privacy Policy

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App. Continued use of the App after changes constitutes acceptance of the new Terms.
